The German government must translate EU requirements into national law before the energy performance certificate can be made mandatory in Germany. The first step in this direction was the passage of the new Energy Conservation Act last year. What is still missing is a new 2006 Energy Conservation Directive which sets out the details for the energy performance certificate. Only once the Energy Conservation Directive has become effective will building owners be obligated to obtain energy performance certificates whenever they intend to construct, sell or rent a home. This applies to existing residential as well as office and service buildings. Energy passes are nothing new to new buildings as they have been subject to this requirement since 2002.
The schedule for the introduction of the 2006 Energy Conservation Directive remains to be clarified.
